RENT, FEES AND SECURITY DEPOSIT ARE DUE AS SET FORTH IN EMAIL. Entire amount must be paid in full 45 days prior to the check-in date. Owners accept PayPal and major credit and debit cards. Rent shall not be refundable in whole or in part except in the case of cancellations more than 90 days prior to the scheduled check-in date. In the latter case, an administrative fee of $200 will be deducted. We have a stringent cancellation policy because we have only one property to rent, we may have turned down other business after we confirmed your reservation, and we may be unable to fill the dates you reserved. We hope you understand our position. If you are uncomfortable with it, you may wish to purchase travel insurance. Such insurance is available from various companies, such as Travelguard ( and AAA.

RESERVATIONS ARE UNCONFIRMED until a fully executed contract has been received and the initial payment has cleared. The reservation will then be confirmed in writing. Reservations are subject to cancellation without refund if scheduled payments due subsequently are not timely received by owners.

THIS IS A NON-SMOKING HOME. No smoking is allowed within 20 feet of the house. Please, if you are unwilling to abide by this rule, don’t rent this house. In the event of any damage caused by smoking, or in the event the odor or other evidence of smoke is detected in the premises after renter vacates, the entire security deposit will be forfeited. We are absolutely firm on this policy.




a.    MAXIMUM OCCUPANTS: There shall be no overnight occupants other than those listed by Renter in the executing email. The house may be occupied by no more than TEN overnight guests unless expressly agreed upon in writing by an Owner. The published daily rate is for SIX occupants. There is an additional charge of $20 per day, or $140 week, for each occupant in excess of six. The bedroom arrangement is one QUEEN bed in master bedroom, one KING bed in second master bedroom, one KING bed in the third bedroom, one double bed in master bedroom annex, and folding futons in the loft area.              

b.    PARTIES ARE PROHIBITED. There are to be NO large parties or gatherings at this house. A large amount of traffic and noise is disruptive to the neighbors. No more than 12 people may be on the premises at any one time, including the occupants listed by the Renter in the executing email.  Violation of this provision may result in eviction without refund.

c.    CHILDREN: Parents are responsible for the behavior and the safety of their children. 

d.    AGE LIMITS: The premises will not be rented to vacationing students or persons under the age of 25 years unless accompanied by a parent or adult guardian. 

e.    PETS: This is a pet-friendly vacation rental. If you wish to bring a pet YOU MUST get authorization from an owner BEFORE signing the rental agreement. Renter is responsible for the pet and for ANY damage, stains or excessive cleaning requirements the pet may cause. Pets must be kept on leashes when outdoors. Pets are not allowed on furnishings. The pet is NOT to be left alone and unattended in the yard or house. If you wish to leave the pet, it must be kept in a travel kennel or in the enclosed garage area. If the pet is disturbing the neighbors in any way the Renter will be asked to remove it and board it at a suitable boarding facility. Please DO NOT bring untrained animals and animals which are not house broken. There is an additional cleaning charge of $30 for each pet. There will be a $50/day charge for any pet brought to the premises and not listed by Renter in executing email. Bringing unauthorized pets will result in immediate eviction without refund. 

Renter is responsible for clean up of pet waste. Pets must be treated with Advantage or comparable flea and tick control three days prior to arrival.

The security deposit will not be refunded if any of the following occur: i) If any fleas are found on the premises after check out. ii) If pets have urinated or defecated on carpeting or furnishings, or have damaged wood flooring. iii) If pets have been allowed in the spa. 

2. MAXIMUM VEHICLES: There are to be no more than 3 vehicles brought to the premises unless expressly agreed upon in writing by an owner. 

3. ALL OCCUPANTS MUST BE IDENTIFIED AT TIME OF SIGNING RENTAL AGREEMENT. At no time may a renter let, sublet, or assign this agreement for all or any part of the premises without prior consent of an owner. No changes may be made to the list of occupants without the express written consent of an owner.  Additional charges and fees will be due if the declared occupancy is exceeded.  Owners may consider the number of beds and linens used in assessing whether this has occurred.

4. Renter assures the Owners and warrants that all occupants and any guests of an occupant will observe all conditions and terms of this agreement as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors. At no time should the Renter contact any neighbors in regards to questions, problems, directions, etc. All such matters should be discussed with an Owner or property manager. 

5. Renter assures the owners and warrants that any occupant or guest of an occupant who violates any of the terms of this agreement shall be immediately denied occupancy. Violations will result in the forfeiture of the security deposit. In addition, Renter shall remedy any damages and reimburse Owner for all expenses which are caused by any occupant and/or any guest(s) of an occupant. 

6. Renter agrees that any person who is found using illegal drugs or allowing others to use illegal drugs on the premises will be immediately denied occupancy and access to the premises. 

7. Renter, occupants and/or guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit any nuisance on or about the premises.  Quiet hours are 10:00 p.m. to 8:00 a.m.

8. Renter agrees that during the term of this agreement and such further time as he/she occupies the premises, he/she will keep the premises clean and free of trash, garbage, and other waste; and will maintain the premises, equipment and fixtures in the same condition as at the time renter’s occupancy commenced, excepting only reasonable wear and tear. Furnishings are not to be rearranged. 

9. Upon not less than 24 hours notice, renter shall make the premises available to owners or their agent for the purpose of making necessary or convenient repairs and to show the premises to prospective buyers or renters. In an emergency, Owners or their agent may enter the premises at any time without securing prior permission from renter. 

10. If Renter abandons or vacates the premises, Owners may at their option terminate this agreement, enter the premises, and remove all property of renter, occupants and/or their guests. 

11. Either party may terminate this agreement in the event of a violation of any provision hereof by the other party, in the manner and as provided by law. 

12. Renter agrees to follow all instructions contained in the “Need to Know Manual and Instructions For Our Guests” binder at the house, and all posted cautions and instructions. Renter agrees to indemnify and save owners harmless for all liability, loss, or damage arising from any act or omission, or breach of this agreement, by Renter, occupants or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises during Renter’s occupancy. 

13. Cleaning fees are not refundable. The security deposit will be refunded within 14 days of the date Renter checks out, if and only if: 

              a. There is no evidence of damage caused by smoking, or smoke odor, or other evidence of smoking in the house. 

              b. There have been no violations of this agreement by Renter, occupants or guests of occupants. 

              c. Owners have suffered no losses or damages as a result of contraband, pet behavior, missing/damaged items, over-stays, or acts, omissions or neglect on the part of Renter, occupants or guests of occupants. 

              d. All furnishings are in their original location, and all lights, heaters, fountain, appliances, etc. are turned off at time of departure. 

              e. All waste and debris have been properly disposed of in accordance with owners’ instructions, all cups, glasses, dishes, tableware, pots, pans, etc. have been properly washed, dried and put away in their original locations. 

              f. All keys and garage door openers were left in the place designated by owners and the house was left locked and fully secured. 

              g. All charges incurred during the stay are fully paid prior to departure. 

Renter is liable for all costs and expense of repairs and replacements needed to restore the premises to the condition they were in at the time occupancy commenced. Our minimum cleaning fee of $130 to $190 covers the standard time required to clean the premises, 6 to 8 hours (varies with number of guests). If this time is exceeded, renter will be charged $20 per hour for additional cleaning and, if applicable, the cost of spa, carpet or furniture cleaning or other restoration. The following are examples of a few of the reasons additional cleaning may be required: home left unusually dirty or in unusual disarray; BBQ left dirty; sand or other substances in spa; spills on carpeting, furnishings or linens; marks or substances on walls or windows; pets allowed on beds or furnishings; towels used for pets or on beach. 

Failure to timely vacate by 10:00 a.m. on the departure date will result in a charge of $25 for the first and second half hours, and $50 per half hour thereafter. 

14. In the event that any action shall be commenced by either party arising out of, or concerning this agreement or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney’s fees as fixed by the Court in addition to all relief at law or equity. 

15. NO DAILY MAID SERVICE. Clean linens and bath towels are provided at beginning of occupancy, FOR PERSONAL USE of occupants WITHIN PREMISES ONLY. If fresh linens or towels are needed during the stay, they must be laundered by renter. (It is not necessary to wash them on departure.) No towels, linens, or other items provided by owner may be removed from the premises at any time. Occupants must provide their own beach and pet towels. 

16. FALSIFICATION/MISREPRESENTATION BY APPLICANT/RENTER: Any reservation obtained under false pretenses or by means of misrepresentation will be subject to forfeiture of all advance payments, and the party will not be allowed to check in. If already in occupancy, the party will be immediately evicted. Any change(s) by Renter to this Vacation Rental Agreement or to the acceptance form provisions set forth in an email sent by Owner to Renter which were not authorized by Owner in a signed writing shall be invalid and deemed to be a misrepresentation. 

17. REFUNDS:   Owners’ only liability to renter if, for reasons beyond their control, owners are unable to provide access to the premises on the agreed check-in date and time, such as but not limited to the failure of an earlier renter to timely vacate the premises, shall be to refund payments made by renter for the time period the premises are unavailable. Partial days shall be prorated on an hourly basis. 

We make every effort to ensure that the spa and all appliances, equipment and services are functioning, and we arrange for any needed repairs as soon as possible after we become aware of a problem.  However, for reasons beyond our control, there is sometimes a delay in obtaining parts or service.  Refunds will not be made for inconvenience due to mechanical failures of equipment or appliances, or because of unavailability of the spa, tv or internet service.

18. This Agreement and the executing email together constitute the entire agreement between the parties. This Agreement may not be amended except in a writing executed by both parties.
